Employers Now Able To Fire Medical Marijuana Users Legally in Washington

Employers in the state of Washington are now legally able to fire medical marijuana patients who are unable to pass a drug use analysis. The Washington State Supreme Court ruled that although the Medical Use of Marijuana Act (MUMA) does protect patients from criminal prosecution, it bears no authority over employment regulations or disputes. This has been a case ongoing since 2006, beginning with a woman who uses medical marijuana to cope with her migraine headaches, was fired from her job at Bremerton customer service for failure to pass a drug test. As the plaintiff attorney was quoted during the case, he would be “flabbergasted if qualified patients could lose their jobs simply for using medical marijuana at home in accordance with the act.”
